Welcome to SweatyPhone. By accessing our website, creating an account, purchasing a subscription, or utilizing our inbound automated voice processing infrastructure (collectively, the "Service"), you ("Subscriber," "Client," or "You") agree to be legally bound by these Terms of Service. If you do not agree to these terms, you are strictly prohibited from utilizing the Service.
1. Scope of Service & Operational Wrapper
SweatyPhone provides a productized software-as-a-service (SaaS) telecommunications architecture. The Service includes provisioning an inbound telephony tracking line, assigning a conversational automated voice routing profile to act as a digital message taker, and transmitting structured message data as internal text alerts to the Subscriber’s designated mobile device. SweatyPhone functions strictly as an administrative data intake transmission utility layer.
2. Carrier Configuration & Forwarding Responsibilities
Subscriber Execution Required: The Service entirely relies on Conditional Call Forwarding (CCF) protocol managed by your independent third-party mobile network provider (e.g., AT&T, Verizon, T-Mobile).
Carrier Limitations: You acknowledge that cellular carrier architecture, local cell tower reception, device settings, and active network configurations can impact forwarding execution. SweatyPhone is a passive recipient of forwarded data and holds zero operational liability or responsibility for carrier-side connection failures, drops, delays, or network-level disruptions.
3. Fair Infrastructure Usage & Spam Defense Boundaries
To safeguard our shared server clusters from automated software scripts, telemarketing loops, or malicious robocall spam storms, standard monthly subscriptions include a fair-use threshold of up to 300 processed inbound voice minutes per billing cycle. Inbound usage scaling beyond 300 minutes within a single billing period is subject to automated platform data throttling or administrative system overage fees billed flatly at $0.20 per minute.
4. Complete Disclaimers & Absolute Exclusion of Liability
No Outcome Guarantees: SweatyPhone makes no representations, explicit warranties, or absolute performance guarantees of any kind regarding business revenue increases, customer retention, job bookings, or specific call volume captures.
Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall SweatyPhone, its affiliates, developers, or officers be held liable for any direct, indirect, punitive, incidental, special, or consequential damages whatsoever. This includes, without limitation, damages for lost project contracts, missed customer communications, text delivery delays, carrier forwarding glitches, or business reputation damages arising from the use or inability to use the automated voice-to-text infrastructure.
The Entire Cap: If any liability is found against SweatyPhone through an authorized legal venue, our total aggregate liability to you for all claims shall never exceed the exact amount paid by you for the single current month of active subscription service.
5. Indemnification
You agree to fully defend, indemnify, and hold harmless SweatyPhone and its underlying technical suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your configuration of the software, your interactions with end-consumers, or any violation of local telephony regulations within your business jurisdiction.
6. Modifications to Service
SweatyPhone reserves the right to modify, update, or optimize system parameters, prompt structures, or infrastructure routing layers at any time without prior notice to maintain overall service integrity and security.
